Terms of Service

The terms for commissioning a livery from Ginger Liveries.Effective

About these terms

These terms apply when you commission a livery from Ginger Liveries through this site. "I" and "me" mean Ginger Liveries, and "you" means the person placing the order.

Your account

You need an account to place an order. You create it with an email address and a password, or through Google or Discord, and you agree to these terms and the Privacy Policy when you do.

You can delete your account at any time from your account settings. The Privacy Policy says what that removes and what is kept.

Who can order

You must be at least 18 to place an order. If you are younger, you need a parent or guardian's permission first.

Placing an order

You place an order by choosing a service and filling in the brief: the game, the car, the number, the name on the car, a description, any links, and up to 10 reference images.

The brief cannot be changed once the order is placed.

Nothing is charged when you place the order. Paying later puts your order in the queue.

Your uploads

You confirm that you have the right to use any logos, images or other material you upload with a brief, and that I may use them to make your livery.

Price and payment

Every service and its current price is on the services page, and the price of your order is shown in its summary. Prices are in US dollars.

You pay through PayPal on the order's pay step. Inside PayPal you choose how to pay, and Venmo is also an option. This site never stores your card details.

If we agree another way to pay, such as an invoice, I will record the payment on your order myself.

Until you start paying, I may change an order's price, for example if the brief needs more or less work than the service covers, or we agree extras. The price shown on the pay step is the price you pay.

Additional versions, changes after delivery and short-notice requests carry extra fees, and anything like that is agreed before you commit.

Turnaround

Each service lists its turnaround. The first draft is counted from the day you pay, using the turnaround the service listed when you placed the order.

How long a livery takes also depends on the current workload, and once work begins I can give you a closer estimate.

Turnaround times are estimates, not guarantees.

Drafts and revisions

The revision rounds included with your order are the ones its service listed when you ordered, shown in the order summary. Some services include none.

When a draft is ready I email you, unless you have turned that email off in your account settings, and you ask for changes with Message about this order on the order's page in your account, or by email or Discord if you prefer.

Delivery

When the livery is finished you download it from the order's page in your account. You receive game-ready files in the right format for your sim; for iRacing that is the livery TGA and the spec map MIP.

The layered source files stay with Ginger Liveries.

Cancellations and refunds

There is no cancel or refund button on this site. To cancel an order or ask for a refund, use Message about this order on the order's page in your account, or contact me by email or Discord. It is arranged directly with me, because a livery in progress is rarely a clean cancellation.

Once a livery is delivered the sale is final, but I may still agree a refund case by case. What happens to a delivered livery is agreed as part of any refund.

For an order paid through PayPal, a refund is returned through PayPal.

If something is wrong with an order, please message me before opening a PayPal dispute, so we can sort it out first.

Once an order is cancelled or refunded, its files are no longer available to download from your account.

Using your livery

Your livery is delivered for your own use in sim racing. If you ordered a livery for a team, everyone driving for that team may race it. Race it and share screenshots as much as you like, but please do not resell it or redistribute the files.

I keep the copyright in the design and in the layered source files.

I may show finished liveries on this site's work page and on social media. If you would rather I did not, tell me and I will leave it out.

Liability

Liveries are provided as they are, without any promise beyond what these terms say. As far as the law allows, my total liability for an order is limited to the amount you paid for it.

Changes to these terms

I may update these terms. The version in effect when you place an order applies to that order, and the effective date at the top shows when they last changed.

Governing law

These terms are governed by the laws of the United States and of the state where Ginger Liveries is based.
